El objetivo de este trabajo es mostrar la importancia que tiene recuperar el concepto de «ideología» y con él la labor de crítica ideológica en la teoría del derecho. En las teorías positivistas de Kelsen y Ross era uno de los conceptos centrales, pero cayó paulatinamente en desuso en la segunda mitad del siglo xx, tanto a nivel político como en el campo específico de la teoría jurídica. En este trabajo se examinan algunas de las razones por las que se (...) dejó de utilizar y se propone un concepto de «ideología» capaz de evitar esos cuestionamientos. Por último, se ponen de manifiesto las consecuencias perjudiciales (tanto teóricas como prácticas) que trae aparejado el abandono de la crítica ideológica en la teoría jurídica. Se utiliza como caso de estudio la concepción postpositivista sobre la naturaleza del derecho defendida por Manuel Atienza y algunas de las decisiones argumentativas que el propio Atienza ha adoptado guiado por ella en una polémica sobre el estatus normativo de la gestación por sustitución en la práctica jurídica española. Es muy defendible afirmar que el volumen dedicado a Spinoza de la obra Historia de la filosofía moderna de Kuno Fischer es la mediación más importante –si bien no la única– para comprender la relación Spinoza-Nietzsche. A partir de la lectura de esta obra en 1881, Nietzsche reconoce a Spinoza como precursor e identifica una tendencia en común entre ambos: «hacer del conocimiento el afecto más potente». Los principales objetivos de este trabajo son destacar la exposición que Fischer lleva a (...) cabo de algunos de los contenidos de la filosofía spinociana para poder valorar mejor su influencia en Nietzsche y resaltar la importancia que tiene tulo 22 de la edición de 1865, titulado «La voluntad humana», donde se interpreta la voluntad como deseo consciente, lo que tendrá sus consecuencias en la recepción de Nietzsche de la filosofía spinociana, además de permitir una discusión respecto del rol no siempre atendido de la voluntad en Spinoza. En este trabajo centrado en la Ética se resaltará la dimensión de alteridad de la esencia del ser humano y, por lo tanto, en el caso de Spinoza, de la noción de deseo. A partir de esta alteridad constitutiva, el modo dicotómico de pensar lo social y lo individual es reconsiderado mediante un deseo que, sin dejar de ser singular, es y persevera en relación con los demás. Con el fin de no reducir la noción de deseo a una de (...) sus expresiones, se distinguirá entre las diversas formas del deseo, en particular el anhelo, y el deseo-cupiditas. Asimismo se perfilará la noción de un deseo de razón en contraste con las figuras de la impotencia. Las vías abiertas conducen a la valoración de un pensador que nos legó una noción de deseo que implica simultáneamente afirmación y codependencia, insertándolo en debates éticos, políticos y psicológicos actuales. Nietzsche identificó la filosofía como _arte de la transfiguración _en la edición de _La gaya ciencia_ de 1887. Esta expresión tiene un fuerte vínculo con la última obra de Rafael Sanzio, _La trasfigurazione_, comentada en _El nacimiento de la tragedia_, en donde el arte es considerado como transfigurador. Tanto la filosofía como el arte se relacionan con el acto de transfigurar y ambas deben ponerse en relación con la vida; la cual ha de ser transfigurada por el amor.

This article is concerned with the Spinozian topic of understanding human actions and its interpretation by Nietzsche in The Gay Science 333. Nietzsche doesn’t read directly Spinoza’s work but rather the volume of Kuno Fischer’s History of Modern Philosophy dedicated to the XVIIth century philosopher; this can be confirmed by the way in which the text is quoted. Even if Nietzsche reduces greatly the power of understanding to one of its aspect translating intelligere as erkennen, it is necessary to emphasize (...) that the aphorism presents a novelty that can enrich the study of the relationship between these two philosophers. Nietzsche identifies conscious thought with the “last scenes of reconciliation” between different drives of a previous unconscious process. Even if the point of departure of this survey is the centrality of affects in both thinkers, it will also identify a precise limit which distances Spinoza’s understanding of the affects from the centrality of drives in Nietzsche’s philosophical project. In general, the development of the theory of the legal system has focused on the contributions of legal positivism authors, leaving to one side the contributions of natural law theory. This study seeks to rebuild the theory of the legal system developed by the School of Salamanca’s founder, Francisco de Vitoria, showing its explanatory advantages in comparison with the first analytical legal theory of legal system formulated by John Austin. This study shows that, just as in Austin, it is possible (...) in Francisco de Vitoria to reconstruct the existence and identity criteria of legal systems from the notions of command and sovereignty. These findings allow us to maintain that 300 years before Austin, and in a non-analytical environment, Francisco de Vitoria developed a theory of legal system. (shrink)

After examining some of the most fundamental aspects of the general concept of ‘neuroright’ in the current discussion, this paper analyzes the concept of ‘the mental’ contained in the very first law of neurorights in the world currently under discussion in the Senate of the Republic of Chile (Bulletin 13.828-19 of the Chilean Senate). It is claimed that the lack of specificity of the target notion might not only posit difficulties for the creation of specific legal frameworks for the protection (...) of subjects from potential misuses of neurotechnologies with access to neural data, but it might also make very difficult the process of decision-taking when interpreting the law. En la recensión se presenta la obra de Byung-Chul Han, quien a través de una serie de comparaciones entre el budismo Zen y la filosofía moderna occidental pretende señalar la riqueza del pensamiento oriental y las posibilidades que brinda al desarrollo de la filosofía contemporánea.

A partir de la divergencia de M. Foucault con Th. Hobbes con respecto a la guerra como principio y fundamento del poder, se muestra la importancia de esa diferencia conceptual para los análisis políticos contemporáneos. Foucault sostiene que, en las sociedades modernas de Occidente, la comunidad política, y más precisamente la política misma, ha sido el terreno de la guerra librada por otros medios. Por extensión, esta tesis significa invertir el principio de von Clausewitz; a saber, que la guerra es (...) la continuación de la política por otros medios. On the basis of the difference between M. Foucault and Th. Hobbes regarding war as a principle and foundation of power, the article shows the importance of this conceptual difference for contemporary political analyses. Foucault argues that in modern Western societies, the political community and, more specifically, politics itself, has been the space of a war waged by other means. By extension, this thesis entails the inversion of von Clausewitz's principle, namely, that war is the continuation of politics by other means. A partir da divergência de M. Foucault com Th. This chapter argues that from a particularly weak recombination principle and plausible assumptions about the nature of parthood and location, it follows that it is possible that the mereological structure of the material world and that of space-time fail to correspond to one another in very radical ways. The chapter suggests, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of no less unappealing alternatives. We say that a sentence A is a permissive consequence of a set X of premises whenever, if all the premises of X hold up to some standard, then A holds to some weaker standard. In this paper, we focus on a three-valued version of this notion, which we call strict-to-tolerant consequence, and discuss its fruitfulness toward a unified treatment of the paradoxes of vagueness and self-referential truth. For vagueness, st-consequence supports the principle of tolerance; for truth, it supports the (...) requisite of transparency. Permissive consequence is non-transitive, however, but this feature is argued to be an essential component to the understanding of paradoxical reasoning in cases involving vagueness or self-reference. How should political power and influence be allocated in democratic systems? That is, roughly, the core of the boundary problem in democratic theory. As of late, some authors have begun paying increased attention to the methodological aspects of this dispute. This paper attempts to make a twofold contribution to this ‘methodological turn’. On the one hand, it identifies and analyzes five desiderata of a successful principle of democratic inclusion. Any such principle, I argue, must be grounded in a clearly identifiable (...) set of values, must provide a clear standard of inclusion, must specify the relevant modalities of inclusion, must provide sound bridging principles, and must be extensionally adequate. In the first half of the paper, these desiderata are developed and critically scrutinized. On the other hand, I also extract three lessons from the previous discussion. First, that a unique answer to the boundary problem (i.e. one grounded in one single principle) is unlikely. Second, that a satisfactory answer to the boundary problem need not necessarily appeal, as some have argued, to distinctively democratic values. And third, that intuitions about political exclusion (i.e. those requiring or permitting the exclusion of some individuals) should be treated with special caution. (shrink)

La vía por la que se muestra dicha relación es el reconocimiento del papel primordial que esta concede al lenguaje y en especial al que adquiere la forma de discursos que buscan persuadir, a la retórica como piedra angular de la formación ciudadana en cuanto preparación para la vida pública. De esta manera se reconoce la importancia que (...) la retórica tuvo para la filosofía en sus orígenes, y cómo perfilaba otra manera de entender la racionalidad, no como teórica sino como práctica. Después se pasa a mostrar cómo según Chaïm Perelman, a partir de una reinterpretación de cierta parte de la obra de Aristóteles, es plausible postular a la retórica como un modelo más adecuado para entender la filosofía. The year 1992 is a year for reflection, because whether or not the quincentenary celebration of the arrival of the Europeans to this continent seems justified, one cannot escape thinking about the impact of this event on our land.As archeology is my area of study, my reflections are directed toward the changes that came about in the relationship between man and animals after 1492, specifically toward what occurred in Mexico once the Spaniards established themselves in this territory.

I argue that from a very weak recombination principle and plausible assumptions about the nature of parthood and location it follows that it's possible that the mereological structure of the material world and that of spacetime fail to correspond to one another in very radical ways. I defend, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of equally radical alternatives. In this chapter we use methods of corpus linguistics to investigate the ways in which mathematicians describe their work as explanatory in their research papers. We analyse use of the words explain/explanation (and various related words and expressions) in a large corpus of texts containing research papers in mathematics and in physical sciences, comparing this with their use in corpora of general, day-to-day English. We find that although mathematicians do use this family of words, such use is considerably less prevalent (...) in mathematics papers than in physics papers or in general English. Furthermore, we find that the proportion with which mathematicians use expressions related to ‘explaining why’ and ‘explaining how’ is significantly different to the equivalent proportion in physics and in general English. “But surely if it's not irrational, it can’t be OCD!” my friend exclaimed, when I told them about the paper Carolina Flores and Brent Kious provided their excellent comments for. In all fairness, my friend is not working in philosophy, or psychiatry, or in psychology. Still, I take their sentiment to be expressive of a widely held view: if you have a certain mental illness, then you must be irrational. Conversely, rationality guarantees mental health; the sane life is the rational (...) life. -/- In my paper, I attempted to complicate this picture. My main line of thought was that if the sane life is the rational life, we do not have a good conception of rationality yet. For, our best theories of rationality fail to capture what is going wrong in some cases of obsessive-compulsive disorder (OCD). Addressing the criticisms raised by my commentators will allow me to clear up some misunderstandings and sketch avenues for further work. (shrink)

En base a una confrontación estrictamente racional con la tradición filosófica, Plotino establece un principio transcendente al ser y al pensamiento y que, sin embargo, funge como principio creador, constitutivo y diferenciador de todo lo existente: el Uno o la Unidad absolutamente simple. En sí mismo inaccesible, se manifiesta ya sea por revelación (la cual sólo es una hipótesis para Plotino) o por sus efectos. Por eso, el discurso filosófico sobre el Uno sólo es posible desde la perspectiva de la (...) multiplicidad y, por tanto, tiene un carácter aproximativo. La forma que este discurso asume es necesariamente la de las vías analogiae, eminentiae y negationis. De este modo, la razón misma nos remite por primera vez a un principio que le antecede y que, a la vez la funda, dándose así inicio a una segunda época en la historia de la filosofía. (shrink)

We study whether robots can satisfy the conditions of an agent fit to be held morally responsible, with a focus on autonomy and self-control. An analogy between robots and human groups enables us to modify arguments concerning collective responsibility for studying questions of robot responsibility. We employ Mele’s history-sensitive account of autonomy and responsibility to argue that even if robots were to have all the capacities required of moral agency, their history would deprive them from autonomy in a responsibility-undermining way. We will also study whether humans and technological artifacts like robots can form hybrid collective agents that could be morally responsible for their actions and give an argument against such a possibility. I give shape to a neglected debate in metaphysics, the debate over the ontological priority between individuality and collectivity. I distinguish the debate from more familiar ones in the recent literature and articulate what I call ontological collectivism, the view that collectivity is prior to individuality. I defend the in-principle intelligibility of the view from forceful general objections and argue that not only is it coherent but also of significant interest to the literature: it allows for overlooked alternatives on a (...) variety of central discussions. The main purpose of these introductory remarks is to give the reader a sense of Philip Rossi’s philosophical project and its importance. I will then advance an interpretation of what motivates Kant’s commitment to community, and, on its basis, object to Rossi’s views on radical evil –a point which affects how one should conceive the moral vocation of humanity and the role that politics and religion play within it. One of the key problems the field of Machine Consciousness is currently facing is the need to accurately assess the potential level of consciousness that an artificial agent might develop. This paper presents a novel artificial consciousness scale designed to provide a pragmatic and intuitive reference in the evaluation of MC implementations. The version of ConsScale described in this work provides a comprehensive evaluation mechanism which enables the estimation of the potential degree of consciousness of most of the existing artificial (...) implementations. This scale offers both well defined levels of artificial consciousness and a method to calculate an orientative numerical score . A set of architectural and cognitive criteria is considered for each level of the scale. This permits the definition of a cognitive framework in which MC implementations can be ranked according to their potential capability to reproduce functional synergies associated with consciousness. The probability of the implementations having any phenomenal states related to the assessed functional synergy is not specifically addressed in this paper; nevertheless, it could be thoughtfully discussed elsewhere. In a recent paper, Barrio, Tajer and Rosenblatt establish a correspondence between metainferences holding in the strict-tolerant logic of transparent truth ST+ and inferences holding in the logic of paradox LP+. They argue that LP+ is ST+’s external logic and they question whether ST+’s solution to the semantic paradoxes is fundamentally different from LP+’s. Here we establish that by parity of reasoning, ST+ can be related to LP+’s dual logic K3+. We clarify the distinction between internal and external logic and (...) argue that while ST+’s nonclassicality can be granted, its self-dual character does not tie it to LP+ more closely than to K3+. Frost's article advocates for universal models of reading and critiques recent models that concentrate in what has been described as “cracking the orthographic code.” Although the challenge to develop models that can account for word recognition beyond Indo-European languages is welcomed, we argue that reading models should also be constrained by general principles of visual processing and object recognition.
